Please read these Terms of Service ("Terms") carefully before using the Nomad Reminder mobile application ("App") operated by Diffuse Thinking LLC ("we", "us", or "our").
1. Acceptance of Terms
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
2. Description of Service
Nomad Reminder is a timezone-aware reminder application that allows you to:
- Create and manage reminders in any timezone
- Receive notifications for your reminders
- Sync reminders across devices (iPhone, iPad, Mac) via iCloud
- Add locations to reminders for navigation
- View a world clock with multiple timezones
3. User Accounts
The App uses your Apple ID for iCloud synchronization. You are responsible for maintaining the security of your Apple ID and any activities that occur under your account.
4. Subscriptions and Payments
Free Version
The free version of the App includes all core features with advertisements.
Premium Subscription
- Premium subscriptions are billed monthly or annually through the Apple App Store
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- You can manage and cancel subscriptions in your App Store account settings
- No refunds will be provided for partial subscription periods
Lifetime Purchase
The lifetime purchase is a one-time payment that grants permanent access to all premium features, including future updates.
5. User Conduct
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Interfere with or disrupt the App or servers
- Circumvent any security features of the App
- Use the App to transmit malware or harmful content
6. Intellectual Property
The App and its original content, features, and functionality are owned by Diffuse Thinking LLC and are protected by international copyright, trademark, and other intellectual property laws.
7. Data and Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability or fitness for a particular purpose
- Warranties that the App will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy of timezone calculations or notification delivery
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIFFUSE THINKING LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or business opportunities
- Missed appointments or reminders
- Damages resulting from timezone calculation errors
- Damages resulting from notification delivery failures
Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Diffuse Thinking LLC from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
11. Third-Party Services
The App may integrate with third-party services such as:
- Apple iCloud for data synchronization
- Google AdMob for advertisements (free version)
- Apple Maps and other navigation apps
Your use of these services is subject to their respective terms and privacy policies.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the App after any changes constitutes acceptance of the new Terms.
13. Termination
We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Diffuse Thinking LLC operates, without regard to conflict of law principles.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.
